廢軍審法林毅夫可解套回台？國民黨立委呂學樟認為，還有很長的路要走！（圖：資料照）

針對立法院三讀通過軍事審判法修正案，引發外界質疑投敵叛逃犯林毅夫是否將可順勢解套返台，國民黨立委呂學樟今（13）日表示，「叛逃罪並沒有移轉到一般司法」，因此現在談林毅夫可望解套的說法是言之過早，「他的追溯期沒有消失，會不會解套？還需要很長的時間」。
呂學樟強調，林毅夫敵前叛逃的事件，目前追溯期並沒有消失，因此還是適用軍法。
對於外界質疑林毅夫是否可藉軍審轉一般司法而解套回台，呂學樟說，若從林毅夫事件來看，軍事審判法將來一部分轉移到一般法院，「是不是會有解套的方式？目前還需要很長的時間」。
呂學樟指出，軍審法轉移到民間司法的部份並沒有包含「叛逃」，「就算用一般法院審判，畢竟罪名是叛逃，並沒有轉移到一般法院審判，所以林毅夫想要解套的機會不是很大」。
